1. Parties and Scope

These Terms of Use ("Terms"); govern the rules for the use of the triporagroup.com website and affiliated digital platforms (together, the "Platform") operated by TRIPORA GROUP TURİZM GAYRİMENKUL VE DANIŞMANLIK LİMİTED ŞİRKETİ ("Tripora").

Any person using the Platform ("User") declares that they have read, understood, and accepted these Terms. If you do not accept the Terms, you should not use the Platform.

2. Description of the Service

As a Group A travel agency member of TÜRSAB, Tripora provides package tour organization, domestic/international tour organization, transfer, accommodation brokerage, visa consultancy, and other travel services. The Platform may be used to review tour catalogs, request quotations, make reservations, and communicate with customers.

3. User Rights and Obligations

The User using the Platform:

1. Must be at least 18 years old or use the Platform with the permission of a parent/guardian.

2. Accepts that all information they provide is accurate, up to date, and complete.

3. If making reservations on behalf of third parties, declares that they have obtained the written consent of those persons and have communicated these Terms to them.

4. Is personally responsible for the security of account information.

5. May not use the Platform in a manner that is contrary to laws, customs, and moral rules.

4. Prohibited Uses

The User may not engage in the following conduct on the Platform:

• Sharing misleading, fake, or unlawful content

• Attempting fraud or identity theft

• Collecting data using automated tools (bots, scrapers, crawlers)

• Infringing Tripora's or third parties' intellectual property rights

• Overloading systems, creating delays, or causing service outages

• Uploading viruses, malware, or exploits

• Sending messages to Tripora staff or other users containing insults, harassment, or threats

• Unauthorized access, account takeover, or exploiting security vulnerabilities

• Reservation requests related to illegal drugs, weapons, or narcotics

If such conduct is detected, Tripora reserves the right, without prior notice, to suspend or terminate the relevant account and to pursue legal remedies.

5. Intellectual Property Rights

The Tripora brand, logo, corporate identity elements, website design, code, software, text, photos, videos, graphics, illustrations, audio, and other content on the Platform, as well as tour content, route descriptions, price tables, and databases, belong to Tripora or its licensors. They are protected under the Copyright and Intellectual and Artistic Works Act No. 5846 and the Industrial Property Law No. 6769.

Without Tripora's written permission, the User may not copy, reproduce, distribute, create derivative works from, communicate to the public, or use these contents for commercial purposes. Viewing for personal and non-commercial purposes and sharing on social media (with source attribution) are excluded from this restriction.

6. Third-Party Services and Links

The Platform may contain links or embedded content directing to third parties such as airlines, hotels, insurance companies, and social media platforms. Tripora is not responsible for the services, content, or privacy practices of these third parties.

7. Service Continuity and Changes

Tripora does not guarantee that the Platform will be uninterrupted, error-free, or completely secure. For maintenance, development, security, or operational reasons, the Company may temporarily suspend service delivery and may change the Platform's features and content without prior notice.

8. Prices and Information Errors

Prices, quota availability, and program details published on the Platform are provided for informational purposes; they may change until a final reservation is made. In the event of clearly incorrect pricing caused by a technical issue or information error, Tripora reserves the right to cancel the reservation and refund the amount collected.

The binding documents regarding tour conditions, pricing, and withdrawal rights are the Package Tour Agreement and the Pre-Information Form.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Tripora is not liable for indirect, incidental, consequential, or punitive damages arising from the use of the Platform, disruptions in third-party services, loss of User data due to User negligence, or force majeure events.

Your rights arising from the Consumer Law are not affected by this article.

10. Indemnification

The User agrees in advance to pay Tripora in full for any lawsuits filed against Tripora, claimed compensation, administrative fines, costs, and attorney fees resulting from conduct that violates these Terms.

11. Privacy

The processing of your personal data is carried out within the framework of the KVKK Information Notice, Privacy Policy, and Cookie Policy.

12. Modification of the Terms

Tripora reserves the right to update these Terms at any time. Material changes are announced in advance on the Platform, via the registered email address, or through other reasonable means.

13. Severability

If any provision of these Terms is found invalid or unenforceable by a competent authority, the remaining provisions remain in effect.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Türkiye. In disputes arising between the parties, the Istanbul (Çağlayan) Courts and Enforcement Offices shall have jurisdiction. With respect to consumer transactions, the Consumer Arbitration Committees or Consumer Courts are competent pursuant to the Law on the Protection of Consumers No. 6502.
