1. Parties and Scope

These Terms of Use ("Terms") govern the rules regarding the use of the triporagroup.com website and associated digital platforms (collectively "Platform") operated by TRIPORA GROUP TURİZM GAYRİMENKUL VE DANIŞMANLIK LİMİTED ŞİRKETİ ("Tripora").

Each person using the Platform ("User") declares that they have read, understood, and accepted these Terms. If you do not accept the Terms, you must not use the Platform.

2. Description of Service

Tripora, as a TÜRSAB member Class A travel agency, offers package tour organization, domestic/international tour organization, transfer, accommodation intermediation, visa consultancy, and other travel services. The Platform can be used for reviewing tour catalogs, receiving offers, making reservations, and customer communication.

3. User Authority and Obligations

The User using the Platform:

1. Must be over 18 years old or use the Platform with the permission of a parent/guardian.

2. Accepts that all information provided is accurate, current, and complete.

3. If making reservations on behalf of third parties, declares that they have received the written consent of those persons and have informed them of these Terms.

4. Is personally responsible for the security of their account information.

5. Cannot use the Platform in a way that is contrary to laws, customs, and ethical rules.

4. Prohibited Uses

The User may not perform the following actions on the Platform:

• Sharing misleading, false, or illegal content

• Attempting fraud or identity theft

• Collecting data with automated tools (bots, scrapers, crawlers)

• Violating the intellectual property rights of Tripora or third parties

• Overburdening the systems, causing delays, disabling services

• Uploading viruses, malware, exploits

• Sending messages containing insults, harassment, or threats to Tripora staff or other users

• Unauthorized access, account hijacking, or exploiting security vulnerabilities

• Reservation requests related to unlawful drugs, weapons, or narcotics

If these behaviors are detected, Tripora reserves the right to suspend or terminate the relevant account and seek legal remedies without prior notice.

5. Intellectual Property Rights

The Tripora brand, logo, corporate identity elements, website design, code, software, text, photos, videos, graphics, illustrations, sound, and other contents, tour contents, route descriptions, price tables, and databases on the Platform belong to Tripora or its licensors. They are protected under the Intellectual and Artistic Works Law No. 5846 and the Industrial Property Law No. 6769.

The User may not copy, reproduce, distribute, derive, transmit to the public, or use for commercial purposes these contents without the written permission of Tripora. Viewing for personal and non-commercial purposes and social media sharing (by citing the source) are excluded from this restriction.

6. Third-Party Services and Links

The Platform may contain links or embedded contents directing to third parties such as airline companies, hotels, insurance companies, and social media platforms. Tripora is not responsible for the services, content, or privacy practices of these third parties.

7. Service Continuity and Modifications

Tripora does not warrant that the Platform will be uninterrupted, error-free, or completely secure. The company may temporarily suspend the provision of services for maintenance, development, security, or operational reasons, and may change the Platform features and content without prior notice.

8. Prices and Information Errors

Prices, quotas, and program details published on the Platform are presented for informational purposes; they may change until a definitive reservation is made. In case of obvious incorrect pricing resulting from a technical failure or informational error, Tripora reserves the right to cancel the reservation and refund the collected amount.

The binding documents regarding tour conditions, price, and withdrawal rights are the Package Tour Contract and the Pre-Information Form.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Tripora is not responsible for indirect, unexpected, consequential, or punitive damages arising from the use of the Platform, disruptions in third-party services, loss of User data due to User negligence, and force majeure events.

Your rights arising from the Consumer Law are not affected by this clause.

10. Indemnification

The User agrees in advance to pay Tripora for all lawsuits, claimed damages, administrative fines, expenses, and attorney fees directed against Tripora as a result of their behavior contrary to these Terms.

11. Privacy

The processing of your personal data is carried out within the framework of the KVKK Clarification Text, Privacy Policy, and Cookie Policy.

12. Amendments to the Terms

Tripora reserves the right to update these Terms at any time. Material changes will be announced in advance on the Platform, via the registered email address, or through other reasonable means.

13. Severability

If any provision of these Terms is deemed invalid or unenforceable by a competent authority, the other provisions remain valid.

14. Applicable Law and Competent Court

The law of the Republic of Turkey applies to these Terms. In disputes that may arise between the parties, Istanbul (Çağlayan) Courts and Execution Offices are authorized. Regarding consumer transactions, Consumer Arbitration Committees or Consumer Courts are authorized in accordance with the Law No. 6502 on consumer Protection.
